Norway - War graves agreement

Agreement between the Government of the Federal Republic of Germany and the Royal Norwegian Government concerning the maintenance of German war graves in Norway, dated October 22, 1953

 

1.) German nationals who died as a result of acts of war and who are buried in Norway are concentrated in a few cemeteries.

 

2) The reburial of the buried, which proves to be necessary, will be carried out by the Norwegian authorities.

 

3) The Norwegian government agrees that a German representative will be present at the reburials in order to assist in the identification of the dead.

 

4) The Norwegian Government will, at its own expense, arrange the German cemeteries in a dignified manner. It declares that the buried are not to be reburied unless important public considerations should make this necessary.

 

5) The Norwegian Government declares itself willing to accept German proposals for the arrangement of the cemeteries and to examine the proposals sympathetically.

 

6) The Norwegian Government declares its willingness to maintain, protect and care for the cemeteries in accordance with the provisions of international law once they have been completed.

 

7) The Norwegian Government notes the announcement that the German War Graves Commission has been authorized by the German Federal Government to take on all the tasks associated with the above.

 

8) Details regarding the implementation of the above shall be settled between the German organization mentioned in point 7 and the relevant Norwegian institution.

 

9) If it is desired that some of the buried be transferred from Norway to Germany, exhumation will not take place until the German federal government has given its consent. The transfers shall be carried out in accordance with the legal provisions in force in both countries.
